Pursuant to the government resolution no. 481 of 20th September 2012, on 2nd October 2012 a gratuitous transfer of registered shares of the company “Slovenská elektrizačná prenosová sústava, a. s.“ was carried out between the National Property Fund of the Slovak Republic and the Slovak Republic on whose behalf acts the Ministry of Finance of the SR. Subsequently to that, from 2nd October 2012 the Slovak republic on whose behalf acts the Ministry of Finance of the SR, became the sole shareholder of the company “Slovenská elektrizačná prenosová sústava, a. s.“

The change of the shareholder in our company emerged from the application of the Directive 2009/72/EC of the European Parliament and of the Council of 13th September 2009 concerning common rules for the internal market in electricity and the Directive 2009/73/EC of the European Parliament and of the Council of 13th September 2009 concerning common rules for the internal market in natural gas, directly or indirectly to exercise control over a transmission system operator or over a transmission system, and directly or indirectly to exercise control or exercise any right over an undertaking performing any of the functions of electricity generation or supply and gas generation or supply. The content of these directives was transposed into the national energy legislation (Act No. 250/2012 Coll. on Regulation in Network Industries and Act No. 251/2012 Coll. on Energy) which came into force on 1st September 2012.

Meeting this legal requirement of ownership unbundling has to be proved by the Slovenská elektrizačná prenosová sústava, a. s., in proceedings concerning granting a certification, which will be carried out in accordance with the Act No. 250/2012 Coll. on Regulation in Network Industries.
