Personal data processing upon claiming reimbursement for establishment of easement
SEPS processes personal data of natural persons (owners of the properties affected by electro-energy construction) themselves or through the authorised contracted supplier.
The legal basis for personal data processing upon establishment of easements in favour of SEPS is Act No. 251/2012 Coll. on Power Engineering and on amendment of certain acts as amended and the related legislation based on which SEPS fulfils the tasks executed in the public interest and it fulfils its legal obligations.
The legal basis for the data subject personal data processing in case of fulfilment of the contractual relationship is the contract fulfilment to which the data subject is a party.
Moreover, the legal basis for personal data processing in case of requests, questions and other suggestions is legitimate interest of SEPS through which they pursue efficient communication with the owner of the land affected by the construction or the representatives thereof.
Every written documentation sent or submitted to the owner of the land affected by the construction contains the information on personal data processing.
Personal data processing upon the owner’s request for claiming reimbursement for establishment of easement
The legal basis of personal data processing of the owner is the Power Engineering Act and the related legislation based on which SEPS fulfils the tasks implemented in the public interest (they establish easements in the public interest) and fulfils the legal obligations. Moreover, the legal basis for personal data processing of the owner representatives are legitimate interests of SEPS through which they pursue efficient communication with the owner or the representatives thereof.
Provision of personal data of the data subject is a legal requirement and in case of the failure to provide them, SEPS cannot fulfil its legal obligations under the Power Engineering Act and the related legislation.
Personal data processing if the contracting party is the data subject:
The legal basis for personal data processing of the owner is fulfilment of the contract to which it is a party (for example the owner of the land affected by the construction is a party to the contract on establishment of easement, the contracting party of the Agreement on determining the amount and method for provision of compensation for ownership rights restriction etc.), as well as fulfilment of legal obligations of SEPS resulting especially from the Energy Act, Commercial Code, Civil Code, Land Registry Act and other related legislation. Moreover, the legal basis for personal data processing of the owner’s representatives are legitimate interests of SEPS through which they pursue efficient communication with the owner as the contracting party or the owner’s representatives.
Provision of personal data of the owner is a contractual and legal requirement and in case of the failure to provide them, SEPS cannot fulfil its legal obligations and no contractual relationship is established.
Profiling
No automated decision-making or profiling occurs upon processing of the owner’s personal data.
Provision of personal data to the third parties
The personal data of the owner may be provided especially to the following beneficiaries: contractual partners of SEPS and other authorised entities, (e.g. Building Office, District Office, cadastral area, Central Register of Contracts etc.)
Data transmission
SEPS does not intend to transmit personal data of the owner into the third country or an international organisation.

Personal data categories
The data subjects whose personal data are processed are persons within the reach of the camera moving in the monitored space. The subject of processing is a video recording of the data subjects moving within the monitored space. Before entering the monitored space, the data subject has the information on monitoring in the form of a pictogram.
Rights of the data subject
The data subject shall have the right to request the information whether the personal data of the data subject is processed and in what extent. The data subject shall be entitled to access these personal data. The data subject shall have the right to erase personal data unless prevented by the legal obligation to keep personal data.
Legal basis for personal data processing
SEPS processes personal data based on the legitimate interest of SEPS in order to protect property and to ensure safety of equipment, critical infrastructure elements and premises. The purpose of personal data processing is monitoring of permitted and non-permitted entries into the SEPS premises and premises of the critical infrastructure elements.
Storage period
The company keeps personal data for the period of 7 calendar days from the date of the camera recording or during the inevitable period if this record is provided to the law enforcement authorities.
Profiling
No automated decision-making or profiling occurs upon processing of the data subject personal data.
Provision of personal data to the third parties
Data subject personal data may be provided to the law enforcement authorities in case of committing misdemeanor or criminal offence or to the contractual partners which process personal data on behalf of SEPS.
Data transmission
SEPS does not intend to transmit personal data of the data subject into the third country or an international organisation.
